Application of Pebble Finish and Refurbishment of Existing Pool

This is a set of our standard contractual terms and conditions, unless otherwise stated in writing in a separate contract or in our quotation, this set of conditions will be recognized by PEBBLE PRO and you as “the client” upon acceptance of our quotation.

Payment Schedule:

30% – On acceptance of the quote and order of Pebble
material
50% – On day of arrival of the workers to job site
20% – On day of completion of the pebble application

Payment of these amounts are due within 5 days of the date of the invoice and is to be made via bank transfer to the account number supplied by Iberia Blue. Late payments are be subject to the application of interest at the legal minimum rate of 5% (artº 102 do Código Comercial de Portugal)

The price includes the application of a scratch coat, application of Pebble Pro™ finish and acid wash. This finish is applied at an average thickness of 1cm to a solid and level concrete surface. This concrete cannot be full of fishers or cavities or be a smooth surface from shuttered and poured concrete. The concrete structure cannot have received any insulation applied to the surface or included in the concrete. The concrete structure must have been cured for AT LEAST 28 days before pebble application.

All terracing and other works around the pool must be completed before pebble application undertaken. If concrete has not been cured or works around the pool structure not completed when client requests Pebble Pro to complete the application, the client acknowledges and accepts full responsibility for any situation arising from this such as but not only subject to: – staining of the pebble, cracking of the pebble and levels of the terrace. If the pool requires extra work to prepare the shell for application extra costs will be incurred. If Pebble Pro is also contracted to remove an existing finish before application of Pebble back to the concrete structure in preparation for the application of pebble it is understood by the client that removing a finish can reveal unforeseen additional work (tiles under a liner, frail structure under tiles etc) Pebble Pro reserves the right to refuse extra unforeseen work but an optional adjustment of the quote @ standard prep prices to cover extra costs of material and labour can be discussed. It is clearly understood by the client that if before or during this process it is found that the concrete structure  underneath contains any small nonstructural cracks, Pebble Pro may be able to seal small existing cracks, yet at no point does the sealing of any existing cracks to the concrete by Pebble Pro form any guarantee or agreement from Pebble Pro over the future cracking of the concrete structure.

Pebble Pro will not be responsible if any cracks appear in the concrete structure at any point in the future.

Iberia Blue reserves the right to re-measure the concrete surface area before the application to confirm total surface area to be covered is the same as the drawings and measurement supplied at time of quotation. Any additional square metres will be charged at the m2 rate.

All efforts should be made to arrange application of Pebble outside of expected bad weather. Pebble should not be applied in rain or in temperature lower than 7ºC. If rain occurs during the time that Iberia Blue is expected to apply pebble and the work is delayed, Iberia Blue cannot be held responsible nor incur any costs from the client.

These finishes are a hand applied render finish that cannot be applied using a mould. Therefore, the client understands that the finish is a smooth non slip finish yet due to the nature of hand application the levels may not be 100% straight in all areas.

These finishes are a cement-based finish that has been manufactured to be durable and long lasting. Due to its nature it is necessary to protect the finish by filling the completed pool with clean water within 2 days and the pool filtration system turned on immediately to keep the water clear. Pool chemical abuse, pool water conditions and lack of maintenance are to blame for most surface problems. A proper start up and regular maintenance is critical in sustaining an aesthetically and long-lasting pool finish. If the water to be used in the pool is considered to be “hard water” containing amounts of calcium, it is suggested that the first fill of water should be done with the calcium removed or that the pool is brushed and vacuumed several times a week during the first 2 weeks to reduce any chance of calcium attaching to the new finish.

Follow the recommended start up and daily maintenance care that is available at www.pebble-pro.com. Iberia Blue is not responsible for any calcium deposit that appear on the pool surface where “hard water” is prevalent. If the water to be used in the pool is considered to be “hard water” containing amounts of calcium, it is suggested that the first fill of water should be done with the calcium removed or that the pool is brushed and vacuumed several times a week during the first 2 weeks to reduce any chance of calcium attaching to the new finish. Pebble Pro is not responsible for any calcium deposit that appear on the pool surface where “hard water” is prevalent.

The Guarantee period commences from the day of the completion of the pebble application. Pebble application inside pools with cement is for 5 years from that date. Any pebble finish with cement outside of the pool and not in permanent contact with water carries no guarantee. During the guarantee period Iberia Blue will put right any defects in the work due to faulty workmanship or materials supplied by them

Iberia Blue Lda acknowledges that they have viewed the pool and can apply the pebble finish to the structure, yet this in no way forms an agreement that Iberia Blue Lda guarantee the concrete structure. If during the guarantee period a fault appears within the structure which causes a fault with the pebble finish, Iberia Blue cannot be held responsible for either fault in the structure or the pebble finish. Iberia Blue is not at any time responsible for the integrity of the concrete structure, even if Iberia Blue is also contracted to remove an existing finish before application of Pebble and in doing so exposes the concrete structure and does any minor work to the said concrete structure, it is clearly understood by the client at no point will Iberia Blue be held responsible for the concrete structure in any level at any time in the future.

Some loss of pebbles in the finish is expected in the first 28 days, this is not considered faulty. Minor surface check cracks or crazing is not considered a defect. Colour loss or fading is not covered by this warranty. This warranty shall not cover damages that have been caused by physical abuse or neglect, through lack of proper water chemistry balancing or other chemical abuses, or sanitation applications. Pebble Pro is not responsible for calcium deposits or staining due to “hard water” being placed in the pool. The warranty does not cover damage to plumbing, filtration equipment or interior finish due to insufficient or inadequate pool maintenance after completion of the pool.

Pebble Pro shall not be held responsible for incidental and consequential costs including but not limited to water replacement, chemicals and loss of use of pool. Damage to interior finish due to delay in filling the pool for more than 2 days from the completion of the application, dirty water being used or filtration systems not being started immediately on pool being filled is not covered by this warranty. Pools (and spas) drained and left empty for more than 5 days will void the warranty. Pebble finishes are not warranted out of water. Pebble Pro is not responsible for defects due to the conditions of the site or relevant property, that existed before began work and material failure caused by structure damage. All pool finishes are composed of natural materials that have certain inherent characteristics. Normal mottling could occur across the surface resulting from difference in moisture content and/or rate of hydration within the surface coating. Normal mottled variation is not considered faulty, but a normal characteristic of cementitious products. The warranty period lose validity if any material has had inadequate use or has been modified or maintained by non specialized personal. For Public pools, the operator is subject to the holding of a health book in which he must record when and how it has made contributions of treatment products, and transcribe every day in public swimming pool, the operator is subject the keeping of a health record on which he must record when and how it has made contributions of treatment products, and transcribed daily analysis of pH and disinfectant, allowing a posterior controls.

These pools are also subject to the obligation of a daily intake of fresh water and a total change every six months, putting away secondary chemical reactions, the most damaging but only develop on the long term. The guarantee will be void if the health card is not properly informed or supplied to Iberia Blue upon request.

Construction of Swimming Pools

Iberia Blue will carry out the work: with care and skill and to a good standard. Payment schedule as follows:

5% upon acceptance of this quote
30% before commencement of job.
30% upon completion of concrete shell
30 % upon completion of pool
5% 30 days after completion of pool

Consents you need 

Unless agreed otherwise, you need to get all consents needed and keep any conditions relating to the work (including paying all the relevant fees). If this condition is broken, you will be liable pay Iberia Blue any losses and damages we suffer.

Starting the work, length of the work and the site 

Work will be started within 30 days of receiving deposit and after all consents have been received. The site is to be available to Iberia Blue on the start date and for the time it takes Iberia Blue to carry out the work.

Withholding payment 

If a dispute arises, you may withhold payment after the due date for any payment owed to Iberia Blue, if you give Iberia Blue written notice: before the final date for that payment; saying that you are going to withhold payment; and setting out the reasonable amount you will withhold and the reason for withholding payment; or if there is more than one reason, each reason and the amount which applies to it. Upon receipt of your written intention to withhold payment, Iberia Blue will contact you in writing setting out our intentions to resolve the dispute and our timeframe. Once this has been resolved payment of the withheld amount is due in full within 7 days.

Materials or goods 

Any materials or goods Iberia Blue supply will be: new, unless you agree otherwise; of satisfactory quality; of the description you give for their type. Iberia Blue will get any materials or goods you ask us to, as long as they are available. Iberia Blue will not be liable for: the satisfactory quality of any materials or goods you provide; or the satisfactory quality or whether they are fit for purpose of any materials or goods if the goods or materials that were placed are those suggested by you even after advisement of the possible inadequate use of the specific situation. Iberia Blue will send you a list of any goods, materials and fixtures at the site which we need to remove, for the work period.

Ownership of materials or goods 

Iberia Blue retains ownership of any materials or goods delivered to the site until full and final payment has been received.

Responsibility for the documents 

– You are responsible for the details shown in the documents:
– Meeting all legal requirements (including planning and building regulations); and
– Being fit for the intended purposes.
– You must pay all relevant fees under this condition.
– Iberia Blue is not responsible for the details shown in the documents being fit for the intended purposes
– Iberia Blue will be responsible for the details of any documents we produce being fit for the intended purposes.

Limits on how or when the site can be used 

– There are no limits on how or when the site can be used.
– The following limits apply on how or when the site can be used

Changing the Work 

– If you want to change the work, you must: Confirm this in writing; and do so within 14 days, if you first tell us. Iberia Blue will then adjust the price.
-The price will be adjusted by: Written agreement beforehand; or if not then later written agreement.

Delay or disruption 

If the work is delayed or lasts longer than expected for any reason (other than our fault) Iberia Blue will adjust the price accordingly, as specified in condition 10.2, and, if it is your fault, Iberia Blue will be entitled to claim for any losses and expenses caused.

Your right to end this contract 

Without affecting your other legal rights and remedies, you can end this contract in one (or more) of the following circumstances: If, without reasonable cause and being of Iberia Blues sole responsibility, Iberia Blue: stop work for 15 working days in a row; or fail to work steadily; and you send Iberia Blue a written notice, telling us to restart work or work steadily; and Iberia Blue do not do this within 7 working days of receiving your notice.

Our right to suspend or end this contract 

Without affecting our other legal rights and remedies, Iberia Blue can suspend this contract in one (or more) of the following circumstances:

-If you fail to pay any interim bill and still fail to pay for 7 days after receiving a written notice Iberia Blue send
demanding payment.

-If you, or anyone you employ or your agent, interfere with or obstruct the work or fail to make the site available for Iberia Blue for the contract period.

– If you become bankrupt or go into liquidation, or make a composition or arrangement with your creditors (or any
one or more of these).

After Iberia Blue uses our right to suspend this contract, Iberia Blue can end it, if you are still at fault for a period of 7 days (as specified in conditions ) and Iberia Blue will be entitled to:

• all relevant payments under condition 2; and
• any costs involved in suspending or ending this contract; and
• any losses Iberia Blue suffer (including loss of profit) resulting from suspending or ending this contract.

Extending the contract period 

Iberia Blue may extend the contract period by a reasonable period to take into account any one (or more) of the following:

-Your delayed instructions or lack of instructions on any one (or more) of the following:

– changes to the work.
– your choice of materials.
– If Iberia Blue suspend this contract.
– If the work is obstructed by any matter Iberia Blue do not control.
– Weather conditions which delay or prevent Iberia Blue continuing the work.

Defects liability period 

The defect liability period commences at the date on the final payment invoice. Construction: The concrete shell for 10 years All electrical and mechanical fixtures and fittings supplied by us for 2 years Interior finish for 5 years Refurbishment: All electrical and mechanical fixtures and fittings supplied by us for 2 years Interior finish for 5 years During the guarantee period Iberia Blue will put right any defects in the work due to faulty workmanship or materials supplied by them.

However, Iberia Blue cannot be responsible for any one (or more) of the defects arising: Due to the conditions of the site or relevant property, that existed before began work. Caused by any other person or caused by any event, which happens after the completion date; from anything excluded under condition 6.3; or from damage to interior finish due to delay in filling the pool for more than 2 days from application, dirty water being used or filtration systems not being started upon pool being filled. Some loss of pebbles in the finish is expected in the first 28 days, this is not considered faulty. Minor surface check cracks or crazing is not considered a defect. Colour loss or fading is not covered by this guarantee. This guarantee shall not cover damages that have been caused by physical abuse or neglect, through lack of proper water chemistry balancing or other chemical abuses, or sanitation applications. The guarantee does not cover damage to plumbing, filtration equipment or interior finish due to insufficient or inadequate pool maintenance after completion of the pool.

Pebble Pro shall not be held responsible for incidental and consequential costs including but not limited to water replacement, chemicals and loss of use of pool. From damage to plumbing, filtration equipment or interior finish due to insufficient or inadequate pool maintenance after completion of the pool. The guarantee period lose the validity if any material has had inadequate use or has been modified or maintained by non specialized personal.

For Public pools, the operator is subject to the holding of a health book in which he must record when and how it has made contributions of treatment products, and transcribe every day in public swimming pool, the operator is subject the keeping of a health record on which he must record when and how it has made contributions of treatment products, and transcribed daily analysis of pH and disinfectant, allowing a posterior controls. These pools are also subject to the obligation of a daily intake of fresh water and a total change every six months, putting away secondary chemical reactions, the most damaging but only develop on the long term. The guarantee will be void if the health card is not properly informed or supplied to Iberia Blue upon request.

Subcontracting 

Iberia Blue can subcontract any part of the work, but we will still be responsible for the work

Clearing the site 

Before the completion date we will remove all building rubble, surplus materials, rubbish, and tools on the site and leave it clean and tidy. Iberia Blue will not be responsible for removing any items you, or any person we don’t control, place on the site.

Preparation of the site 

Included in the quote is digger hire to excavate on the basis that the pool levels will be on good ground and that the spoil can be left on site. If we hit hard rock, then extra machinery and labour will be required and additional costs will be incurred. Excavation is also based on that no under floor peering and no re-routing of mains services will be required, if during excavation it is discovered that under peering is required or mains services are located, we will inform you and the additional costs will be advised upon completion of the excavation stage

Supply of water and cleaning of pool on completion 

– The client is required to supply the water for the pool and to ensure the « water is clean and of a good quality.
– Iberia Blue requires water be placed in the pool within 3 days of completing the interior finish
– Iberia Blue can prime the pumps for you the first time if requested, after this, it is necessary to ensure the pool is kept clean and free of debris
– Iberia Blue will not be liable for:

• cleaning the pool upon filling the pool with water
• any staining due to the supply of dirty water or insufficient cleaning of the interior once the pool has been filled with water

Pool safety products 

All our pool safety options are sold as barriers to hinder access to a swimming pool, our products are considered to be an aid for the prevention of drowning and do not replace common sense and individual responsibility. None of these systems should preclude adult supervision.

Pool safety nets

A pool net in good condition properly secured over a pool that is filled to the correct level will support a child above the water and the pool edge. Please be sure to regularly check the condition of the net, fastenings and water level in your pool.


Guarantee
We offer a guarantee for 3 years from the date of installation. The net has been UV and chemical treated and will withstand the harshest climatic conditions and chemicals. The safety net will not shrink when left on or off the swimming pool. The brass anchors and stainless steel hooks will not rust. If you have any problems with your net, please contact us immediately.


Care for your net
The net comes with a 3 year guarantee, yet the net should last for around 8 years when properly cared for. When storing the net, take care not to have any abrasive or sharp objects nearby that could damage the net. Beware that hot area such as BBQ’s or pumps could also damage the net. Dogs and rats have been known to chew on the netting, take care to store the net in a safe place away from rats and when in place over the pool, regularly check for any damage.


Minor repairs
Repairs can be made to your net, please contact us immediately and we will endeavor to repair the net for yo as quickly as possible, a small charge may apply.

Payment
50% deposit is required on ordering a pool net from Iberia blue, as we generally hold our product in stock there is no delay in delivery time. Final payment is required upon installation of the net .

Pool safety fence 

We offer a guarantee for 5 years from the date of installation. The transparent mesh is pvc coated polyester and the fence posts are powder coated high grade aluminum. If you have any problems with your fence, please contact us immediately.


Care for your fence
The fence comes with a 5 year guarantee, yet the fence should last for around 8-10 years when properly cared for. If you take the fence down to store, take care not to have any abrasive or sharp objects nearby and that could damage the net. Beware that hot area such as BBQ’s or pumps could also damage the fence. Rats have been known to chew on the fencing when stored.


Minor repairs
Repairs can be made to your fence, please contact us immediately and we will endeavor to repair the fencing for you as quickly as possible, a small charge may apply.

Pool safety covers with bars

Guarantee
We offer a guarantee from the manufacturer for 3 years from the date of installation. The cover is fabricated from a high grade of PVC coated polyester and the posts are anodized aluminum. If you have any problems with your cover, please contact us immediately.
